Can a state make a law saying you are not allowed to wear the color blue?
Since it doesn’t mention the color blue, or any other color for that matter, directly in the US Constitution, do the states have the power to make a law banning that color, or any other color?
The Constitution of the United States is a grant of SPECIFIC powers FROM the States TO the Federal government. Its basic structure, and the 10th amendment, limit the powers of the FEDERAL Government to those specifically mentioned. The only limits on STATE governments imposed by the US Constitution are those specifically stated. In short, nothing in the US Constitution prevents STATES from passing such a law.
That said, by the same argument, the STATE Constitutions are grants of specific powers from the PEOPLE to the state governments. I doubt you could find anything in any state constitution that granted the state the power to pass such a law.
